AfriTrax Tours Trading As – TerraVia Africa Tours

These Terms and Conditions (“T&Cs”) apply to all bookings made with AfriTrax TOURS, whether directly or through any agent, website, email, or other booking channel. By booking a tour, the client (“you” / “the traveller”) agrees to the following:

1. Definitions

  • “Company” refers to AfriTrax TOURS (T/A TerraVia Africa Tours), including its directors, employees, guides, drivers and agents.
  • “Client” / “Traveller” refers to any person participating in a tour or making a booking.
  • “Tour” means any travel service, package, activity, or product offered by the Company.
  • “Service Providers” include accommodation, transport companies, activity providers, and any third-party vendors.

2. Booking Process

2.1 A booking is confirmed once the Company receives:

  • Acceptance of a submitted quote from the “client / traveller.”
  • The required full payment via EFT, when making the reservation. The reservation will be confirmed via e-mail, once the amount reflects in AfriTrax TOURS bank account.
  • For Private Tours, the “client / traveller” details and requirements need to be submitted in order for a quote to be issued. Once the required amount has been affected via EFT to:

The reservation will be confirmed via e-mail, once the amount reflects in AfriTrax TOURS bank account.

2.2 The Company reserves the right to decline any booking at its discretion.

3. Payment Terms

3.1 Payment Methods:

EFT payments required when making the reservation on the AfriTrax TOURS website.

3.2 Payment Methods:

EFT as stated. Bank charges are the client’s responsibility.

4. Cancellations & Refunds

4.1 Cancellation by the Client

If you cancel your booking, the following apply:

  • 14+ Days before departure (20% of fee charged).
  • 7-14 Days before departure (50% of fee charged).
  • < 7 Days (Last minute)/No show (100% of fee charged)

Non-refundable items: airline tickets, permits, visas, special-request bookings, or expenses already paid to service providers.

4.2 Cancellation by the Company

The Company may cancel a tour due to:

  • Insufficient participant numbers
  • Unsafe weather conditions
  • Force majeure (see Section 11)
  • Any circumstance beyond reasonable control

Clients will receive either:

  • A full refund excluding non-recoverable third-party costs, or
  • The option to transfer to another available tour.

The Company is not liable for additional expenses (flights, visas, hotels, personal costs).

Clients will receive an e-mail informing them of a cancellation as far in advance as is possible.

5. Changes to Bookings

5.1 Changes by the Company:

The Company may adjust an itinerary, route, accommodation, transport, or driver when necessary.

Any changes will be made in the traveller’s best interest or due to circumstances beyond control.

5.2 Changes by the Client:

Requests for changes are subject to availability and may incur an administrative fee.

6. Travel Insurance

Comprehensive travel insurance (medical, cancellation, personal liability, evacuation) is strongly recommended and may be legally required for certain tours.

The Company is not responsible for:

  • Medical expenses
  • Loss, theft, or damage to personal items
  • Costs from missed flights or connections

7. Traveller Responsibilities

Travellers must:

  • Be in suitable health and physical condition for the tour
  • Follow instructions from guides and staff
  • Respect local cultures, laws, and environments
  • Be punctual—late arrival may result in exclusion without refund
  • Disclose medical conditions or dietary restrictions at the time of booking
  • The Company may remove any individual whose behaviour poses a risk or disrupts the tour, without refund.

8. Liability & Indemnity

8.1 The Company acts as an agent for third-party service providers and is not liable for:

  • Delays
  • Accidents
  • Loss, damage, or injury
  • Acts or omissions of third-party providers

8.2 Participation in tours involves inherent risks, including outdoor, wildlife, and adventure activities.
By booking, you acknowledge these risks and voluntarily assume them.

8.3 To the extent permitted by law, the Company’s liability is limited to the amount paid for the tour.

9. Passports, Visas, and Health Requirements

  • Travellers are responsible for having valid passports, visas, vaccinations, and other entry requirements.
  • The Company is not responsible for denied boarding or entry due to incorrect documentation.

10. Complaints Procedure

  • Any complaints must be raised immediately with the guide or Company representative.
  • If unresolved, submit a written complaint within 7 days of the tour’s end.
  • The Company will respond within a reasonable period.

11. Force Majeure

The Company is not liable for failure to perform due to events beyond reasonable control, including:

  • Natural disasters
  • Pandemics
  • Political unrest
  • Strikes
  • Extreme weather
  • Government actions

No refunds or compensation will be provided; however, the Company will attempt to reschedule or offer alternatives when possible.

12. Use of Photos & Media

Unless you notify the Company in writing, you consent to the use of photos or videos taken during the tour for marketing purposes.

13. Privacy Policy

The Company collects personal data only for booking administration and will not share your information except where necessary for service delivery or legally required.

14. Governing Law & Jurisdiction

These Terms and Conditions are governed by the laws of South Africa.
Any disputes shall be resolved in the courts of Cape Town.

15. Agreement

By booking a tour, the traveller acknowledges that they:

  • Have read, understood, and agreed to these Terms & Conditions
  • Accept all associated risks
  • Are bound by this agreement
